It is not easy to cope with the anger, fear, and anxiety one feels while being the silent victim of sexual harassment at your workplace. With confusing advice given by family, friends, and colleagues, it can be difficult to know how to deal with the abuse.

On one hand, you are afraid of losing your job if you protest and complain; on the other hand, the harassment is making your life unbearable.

This is where a sexual harassment attorney comes in; with the help of a committed and empathetic sexual harassment attorney, you can ensure the guilty do not go unpunished, while you’re trying to go on living your normal life.

The law requires that the employee who claims to be harassed contact an Equal Employment Opportunity official within 45 days of the incident. Because of the 45-day deadline, it is important for an employee to speak promptly with a lawyer experienced in these types of complaints.

Understanding the legal definitions and what constitutes harassment can be tricky. Consulting a professional and experienced sexual harassment attorney at Probinsky & Cole can help you to gain clarity and decide on the next course of action as quickly as possible.

Every minute’s delay can impact the chances of winning the case. And with time, it could be possible to forget some of the critical details of the case.

The attorneys at Probinsky & Cole have dedicated part of their practice to employment litigation; including sexual harassment cases; and are successful in helping their clients win their cases. What Is Sexual Harassment?

According to the law, sexual harassment is any “unwelcome verbal, visual, non-verbal or physical conduct of a sexual nature or based on someone’s sex that is severe or pervasive and affects working conditions or creates a hostile work environment”.

Sexual types of harassment include:

  • Leering
  • Making offensive remarks about someone’s looks, clothing, or body
  • Inappropriate touching that might make an employee uncomfortable, including patting, pinching or intentionally touching someone else’s body
  • Making jokes that are sexual or lewd, hanging pictures or posters that are sexual, or making sexual gestures
  • Sending emails, notes, letters, images or other forms of written or graphic communication that are sexually suggestive

The law states that the harassment must be either severe or pervasive to qualify as sexual harassment. Simple off-hand teasing and one-off comments may not be recognized as being either severe or pervasive. But if such comments have occurred regularly enough to create a hostile work environment, it could meet the definition of harassment.

An attorney can examine all aspects of your case, advise you of possible legal options, and help you to decide the next steps to take.
